Terms and ConditionsBelow you find our General Terms and Conditions for Carlos Poker, which will apply to all services transacted through Carlos Poker. Please read the terms and conditions carefully before accepting them. You can close a gaming account with Carlos Poker at any time.
1. General introduction, definitions and stipulations
1.1 "The Carlos Poker Rules" are the Terms & Conditions constituting and governing the contractual relationship, as stated herein, and which the parties, as stated herein, hereby agree upon.
1.2 "Carlos Poker" is a registered trademark. The website www.carlospoker.com is operated by Global Entertainment (Antigua) Ltd, a company duly registered on the 23rd of March 2006, under the laws of Antigua W.I.; Registration No 146212 and having a business address at Registered Office at 44 Church Street, St John's, Antigua W.I. email : helpdesk@carlospoker.com.
1.3 "An Account Holder" is an individual having a contractual relationship with Carlos Poker.
1.4 A "Carlos Poker Account" is an account held by an Account Holder, for bona fide transactions, with a strict aim to establish a normal commercial relationship with Carlos Poker and with the strict purpose of conducting betting and other gaming and gambling transactions.
1.5 The "Contract" is the contractual relationship between Carlos Poker and an Account Holder and shall be constituted under and governed by the Carlos Poker Rules i.e. "the Terms and Conditions".
1.6 The "License" is the approval by the Antigua and Barbuda Financial Services Regulatory Commission (FSRC); Interactive Gaming License nr 2206 and Interactive Wagering License 2207. The Licenses originate from an approval dated the 1st July 2006. For further information regarding the FSRC which is a regulatory authority established by Antigua and Barbuda Law to govern all forms of gaming in Antigua and Barbuda, please go to www.antiguagaming.gov.ag.
1.7 The "Governing Authorities" are the authorities of Antigua.
1.8 The "Governing Law" is the law of Antigua.
1.9 The "Place of the Contract" is Antigua.
1.10 The "Betting Duty" refers to the special tax applicable on betting in Antigua.
1.11 The "Site" is the internet gateway, accessible through the internet address www.carlospoker.com, where all current and relevant information regarding Carlos Poker's operation is published.
1.12 A "Card" refers to all types of cards with a function of "payment", "charge", "debit", "credit", "virtual" and/or similar.
1.13 A "Payment Solution Provider" is an intermediary acting as a payment agent.
1.14 A "Financial Institution" is a bank and/or other institution regulated by an applicable domestic financial services act or similar.
1.15 "Force Majeure" refers to any occurrence or condition beyond one's reasonable control which leads to a delay or default in the performance to the affected party's contractual obligation and shall, for the purposes of the Carlos Poker Rules, include Acts of God, Government restrictions (including the denial or cancellation of any necessary license where such denial or cancellation is made through no fault of the affected party), wars, insurrections and/or any other cause beyond the reasonable control of the party whose performance is affected.
2. Account Rules
2.1 An individual cannot participate in a game unless that individual is registered as a player and holds a Carlos Poker Account. For an individual to be registered as a player, that individual must submit an application for registration, which application will, at least, require the following details:
- that the player is over eighteen (18) years of age;
- the player's identity;
- the player's place of residence; and
- the player's valid e-mail address.
An individual applying for registration warrants and represents that any information provided by it in its application form is true and correct. Carlos Poker will not register the individual and, where that individual has already been registered; Carlos Poker will cancel that individual's registration as a player if it becomes aware that individual has provided false information when registering as a player.
2.2 An individual applying for a Carlos Poker Account acknowledges and accepts:
All definitions and stipulations, as stated under clause 1 and/or herein;- The Carlos Poker Rules as currently published on the Site, as well as any possible future changes to the Carlos Poker Rules;
- That the Place of the Contract is Antigua and;
- That the Contract is governed by:
- The Carlos Poker Rules, as published in English.
- Any regulatory provisions or other decisions made from time to time by the Governing Authorities;
- The Governing Law of the Place of the Contract.
2.3 Carlos Poker reserves the right, at its own discretion, at all times, to:
- Decline to open a Carlos Poker Account and/or to close an existing Carlos Poker Account, without any explanation whatsoever;
- Decline to accept deposits without any explanation whatsoever;
- Suspend and/or cancel the participation of an Account Holder in promotional activities, competitions or other services, whenever Carlos Poker opinions there are legitimate concerns that a Carlos Poker Account is used for illegal, fraudulent or dishonest practices.
- Request documents to verify identity, authorization to use a specific Card and/or other facts provided by the Account Holder, before expediting deposits and/or withdrawals;
- Transfer and/or license, without prior notice, data regarding an Account Holder to any other legal entity, in any country, ultimately managed and controlled by Carlos Poker Group Plc., subject to Carlos Poker guaranteeing that the said data at all times is transferred and managed in accordance with applicable laws, data protection acts and/or similar.
- Transfer and/or license, without prior notice, the rights and the liabilities regarding an Account Holder to any other legal entity, in any country, ultimately managed and controlled by Carlos Poker Group Plc., subject to Carlos Poker guaranteeing the liabilities being honoured.
- Hold and manage funds belonging to Account Holders in accordance with generally accepted guidelines for cash management regarding such funds; this may include a Financial Institution and/or a Payment Solution Provider being entrusted to hold funds in the name of and/or for the benefit of Account Holders;
- Forfeit and/or confiscate funds available on a Carlos Poker Account and/or refuse to honour a claim, in the event that, directly or indirectly, The Carlos Poker Rules have been violated and/or other unauthorized activities have occurred in connection with a betting event and/or the operation of a Carlos Poker Account. This is subject to any of the said events being in connection with the Carlos Poker Account and/or the claim in question.
2.4 An individual applying to become an Account Holder warrants and represents not to be an individual under the age of eighteen (18) years. Minors cannot register as a player and cannot hold a Carlos Poker Account. Carlos Poker reserves the right to request proof of age and performs check in order to verify the information provided. Accounts may be suspended until satisfactory proof of age is provided.
2.5 An Account Holder warrants and represents, at all times, not to be:
2.5.1 Resident of Turkey, Hong Kong, The United States of America and other U.S. territories, Afghanistan, Ethiopia, Iran, Iraq, Jordan, Kuwait, Pakistan, Syria, Yemen, Estonia, Italy and France;
2.5.2 Restricted by limited legal capacity;
2.5.3 Acting on behalf of another party;
2.5.4 Classified as a compulsive gambler;
2.5.5 Depositing monies originating from criminal and/or other unauthorized activities;
2.5.6 Depositing monies through a Card which the Account Holder is not authorized to use and/or utilizing a Card in a jurisdiction in which betting and gaming are prohibited;
2.5.7 Conducting criminal activities whereby a Carlos Poker Account is directly or indirectly involved; and/or
2.5.8 Holding an active account with another legal entity which is part of the same group as Carlos Poker, meaning other entities being, directly or indirectly, controlled by Carlos Poker.
2.6 Carlos Poker warrants and represents, at all times, to:
2.6.1 Manage funds belonging to Account Holders in a secure and appropriate manner; and/or
2.6.2 Absorb the cost of, and pay, the Betting Duty, as applicable, at the Place of the Contract.
2.6.3 Manage data regarding an Account Holder in accordance with applicable laws, data protection acts and/or similar.
2.6.4 Not offer contingency to customers to proceed to any funds transfer between customers account.
2.7 Carlos Poker Account is opened, held and settled in a currency as agreed between Carlos Poker and an Account Holder. All amounts displayed relating to wagers and winnings shall be quoted with the symbol of the currency so agreed to. Carlos Poker calculates and settles all matters involving exchange rates in accordance with recognized financial institutions at currently applicable exchange rates. Slight differences may occur between agreed amounts and recorded amounts due to variances between exchange rates.
2.8 A Carlos Poker Account does not accrue interest.
2.9 An Account Holder can only hold one Carlos Poker Account at a time. In the event that this rule is breached, Carlos Poker reserves the right to block and/or delete the superfluous Carlos Poker Account(s) held by the Account Holder in breach of this clause. Carlos Poker also reserves the right to reallocate all the funds in the different superfluous Carlos Poker Accounts to a single Carlos Poker Account and to delete the remaining superfluous account(s). No bonus given to the superfluous Carlos Poker Account(s) will be reallocated.
2.10 Any claim regarding a transaction in conjunction with a Carlos Poker Account shall be made to Carlos Poker within 6 months after the transaction, payment and/or settlement took place, or should have taken place; otherwise Carlos Poker reserves the right, at its own discretion, not to consider the claim.
2.11 Any legal dispute regarding a transaction in conjunction with a Carlos Poker Account that cannot be solved by the Carlos Poker Rules and in respect of which no equitable solution is reached with the Account Holder shall be settled in accordance with the Governing Law of the Place of the Contract. In the event of a dispute, it is advisable that the Account Holder lodges a complaint with Carlos Poker's customer service. The parties should do their utmost to reach an amicable settlement within a reasonable time. The complainant may also lodge a complaint with the FSRC at http://www.antiguagaming.gov.ag/complaints.asp.
Whereupon a dispute should occur between the Company and the Account Holder, the Company will make accessible to the member a detailed transaction record. Such information will also be made available to a legitimate third party (e.g. a judge or court) if the Company so wishes or agrees. Carlos Poker shall immediately inquire into any complaint made to it or to the FSRC by a registered player in respect of:
- the operation of a game operated by Carlos Poker;
- the conduct of an agent of Carlos Poker in operations related to a game operated by Carlos Poker.
Carlos Poker will inform the complainant or the FRSC where the complaint was referred to Carlos Poker by the FRSC, of the results of the inquiry within twenty-one (21) days from the date on which the complaint has been lodged with Carlos Poker.
The complaint must contain clear and unequivocal information about the complainant's identity, and shall give all the relevant details that gave rise to the complaint.
2.12 An Account Holder may, by written or electronic notice to Carlos Poker:
- set a limit on the amount the Account Holder may wager within a specified period of time;
- set a limit on the losses the Account Holder may incur within a specified period of time;
- set a limit on the amount of time the Account Holder may play in any one session;
- excludes the Account Holder from playing for a definite or indefinite period of time.
An Account Holder who has set a limit or exclusion as above may change or revoke the limit or exclusion by written notice or electronic notice given to Carlos Poker.
A notice increasing or revoking a limit or decreasing the exclusion has effect only after seven (7) days after Carlos Poker has received the notice.
A notice reducing a limit or increasing the exclusion has effect immediately after Carlos Poker receives it.
Carlos Poker shall not accept a wager from a player contrary to a limit or exclusion set by the Account Holder as above.
3. Payment Rules
3.1 Deposits to, and withdrawals from, a Carlos Poker Account shall at all times be made through a Financial Institution or a Payment Solution Provider. Procedures, terms and conditions may vary from time to time, as well as between different countries and different Financial Institutions. Current advice is available when logged in on the Site under the headings "Deposit" or "Withdrawal".
3.2 Carlos Poker shall keep Account Holders' funds separately from Carlos Poker's own funds in a client's account held with a Financial Institution.
3.3 Carlos Poker shall not make a payment in excess of two thousand and three hundred Euros/Û (or its equivalent under the operational currency) out of a Carlos Poker Account of any Account Holder until the Account Holder's identity, age and place of residence have been verified.
3.4 Carlos Poker may appoint a Payment Solution Provider to act, receive deposits, hold and manage funds, and/or expedite withdrawals, on behalf of Carlos Poker.
3.5 Carlos Poker does not accept cash funds sent or delivered directly to Carlos Poker or a Payment Solution Provider.
3.6 Carlos Poker shall credit to the Carlos Poker Account all funds received by Carlos Poker from or on behalf of the Account Holder, or owned by Carlos Poker to the Account Holder.
3.7 An Account Holder may only make a deposit with is personal Card.
3.8 Carlos Poker shall not accept a wager from an Account Holder unless a Carlos Poker Account has been established in the name of the Account Holder and there are adequate funds in the Carlos Poker Account to cover the amount of the wager; or funds necessary to cover the amount of the wager are provided in an approved way.
3.9 Carlos Poker shall not deal with the amount standing to the credit of an Account Holder except:
3.9.1 to debit to the Carlos Poker Account a wager made by the Account Holder or an amount the Account Holder indicates it wants to wager in the course of a game it is playing or about to play;
3.9.2 to remit funds standing to the credit of the account to the Account Holder, at the Account Holder's request,
3.9.3 to pay reasonable bank charges for deposits received and funds withdrawn; or as otherwise authorised by the Remote Gaming Regulations.
3.10 Withdrawals from a Carlos Poker Account are made through payments addressed to the Account Holder or transferred to a bank account held in the name of the Account Holder, as advised by the Account Holder.
3.11 If no transaction has been recorded in a Carlos Poker Account for thirty (30) months, Carlos Poker shall remit the balance in that account to the Account Holder or, if the Account Holder cannot be satisfactorily located, to the Remote Gaming Authority. No claim shall lie against Carlos Poker if it remits the balance in a Carlos Poker Account to the Remote Gaming Authority.
3.12 Placing a bet through the Internet may be illegal in the jurisdiction in which an Account Holder is resident and/or domiciled; if so the Account Holder is not authorised to use a Card for the purpose of placing a bet.
4. Security Rules
4.1 Carlos Poker upholds strict confidentiality regarding all relations with an Account Holder. Data will be disclosed if required by the governing authority, the judge or another public authority, and/or in the event of an Account Holder violating the Carlos Poker Rules, data can be disclosed to a third party for investigation purpose.
4.2 An Account Holder is given a personal account number. The Account Holder chooses a password and username. It is an Account Holder's own responsibility not to share this information. If the Account Holder has reason to believe that others have become party to this information, the Account Holder should immediately contact Carlos Poker's Customer Service and a new password will be issued.
4.3 All telephone communications between Account Holders and Carlos Poker are recorded for security, training purposes and/or accounting purposes.
4.4 All Internet communications are kept on record for accounting purposes.
4.5 Card deposits may, from time to time, be partially and/or fully declined subject to certain security systems managed in collaboration with a Payment Solution Provider and/or a Financial Institution. Such security measures may decline legitimate Cards, which nevertheless, at a particular time, it is not possible to process. Carlos Poker personnel do not control the said systems, nor have they any knowledge, of the reasons for any deposits being declined.
4.6 Carlos Poker may request documents to verify identity and/or authorisation to use a specific Card and/or other facts provided by the Account Holder, before expediting deposits and/or withdrawals; this may cause slight delays. From time to time, charge backs, are received and these will be treated as per the company procedure.
4.7 The use and abuse of a bug in any of the gaming software provided on Carlos Poker platform is illegal. The player detecting a bug on the gaming software must inform Carlos Poker as soon as the bug is discovered by contacting site name at info@carlospoker.com. Carlos Poker shall take all necessary steps in case of a use and/or abuse of a bug from a player as block the player account, freeze the funds and eventually legal proceedings.
4.8 Only one bonus per household/IP address can be used. In case of bonus abuse, said bonus will be forfeited and any funds on this account shall be frozen.
5. Miscellaneous
5.1 All references in the Rules to the singular shall include the plural and vice versa, and all references to "the" shall include "a/an" and vice versa.
6. Disclaimer
6.1 The Carlos Poker Rules as published from time to time in English govern this Contract. Translations into other languages are made as a service and are made in good faith. However, in the event of ambiguity between the English version and a translation, the English version has priority over any translations.
6.2 Account Holders are advised to comply with applicable legislation in the jurisdiction in which they are domiciled and/or resident.
6.2.1 Carlos Poker does not provide advice to Account Holders regarding tax and/or legal matters.
6.2.2 Account Holders who wish to obtain advice regarding tax and legal matters are advised to contact appropriate advisors and/or authorities in the jurisdiction in which they are domiciled and/or resident.
6.3 Carlos Poker does not acknowledge or accept any liability whatsoever for damage to an Account Holder and/or a third party caused directly and/or indirectly due to any:
6.3.1 Mistake, misprint, misinterpretation, mishearing, misreading, mistranslation, spelling mistake, fault in reading, transaction error, technical hazard, registration error, manifest error, Force Majeure and/or any other similar event;
6.3.2 Violation of the Carlos Poker Rules;
6.3.3 Criminal Actions;
6.3.4 Advice provided by Carlos Poker
6.3.5 Financial risk and loss, including, but not limited to variances in exchange rates; and/or
6.3.6 Legal actions and/or other remedies. The SMS notification service is a pure service to the Account Holder. Carlos Poker does not acknowledge or accept any liability whatsoever in the case that there is a mistake in the content of the SMS nor if you have not received the SMS.
6.4 Carlos Poker reserves the right, at all times, to resolve any disputes, at its own discretion, in accordance with principles of equity.
6.5 Carlos Poker shall take all reasonable steps to ensure that Carlos Poker's approved computer system enables any player's whose participation in a game is, after he/she has made a wager, interrupted by a failure of the telecommunications system or a failure of the player's computer system that prevents the player from continuing the game, to resume, on the restoration of the system, his or her participation in the game that was interrupted as at the time immediately before the interruption. If Carlos Poker's computer does not enable any such player to continue, after the restoration of the system, with a game interrupted by a failure of the telecommunications system or the player's computer system, Carlos Poker shall:
6.5.1 Ensure that the game is terminated;
6.5.2 Refund the amount of the wager to the player by placing it in the player's Carlos Poker Account. If a game is started but miscarries because of a failure of Carlos Poker computer operating system, Carlos Poker shall:
6.5.3 refund the amount wagered in the game to the Player by crediting it to the Player's Carlos Poker account or, if the said account no longer exists, by paying it to the Player in an approved manner, and if the Player has an accrued credit at the time the game miscarries, credit to the Player's account the monetary value of the credit or, if the account no longer exists, pay it to the Player in an approved manner;
6.5.4 Refrain from conducting a further game if the game is likely to be effected by the same failure.
6.6 In the event that Carlos Poker is found liable in any way, by a court of law and/or a similar authority, with legal competence and/or jurisdiction over Carlos Poker, then Carlos Poker's liability is limited to the amount of the Stake, or the Net Winnings, whichever is the lesser. Alternatively, when relevant and applicable, the amount recorded in the Carlos Poker Account or the amount transferred into or out of the Carlos Poker Account, whichever is the lesser.
6.7 Participation in games implies the knowledge and the acceptance of the limits of internet, especially:
6.7.1 the technical capacity, the replying time for consult, interrogate or transfer information, the interruption risks, and in general, the risks inherent of any connection and transmission failure.
6.7.2 the absence of protection of data.
6.7.3 the contamination risks by potential virus circulating on the net. Hence, without prejudice to responsibility to Carlos Poker liability as mentioned above, Carlos Poker shall not be responsible for (not limited list):
6.7.4 the transmission and/or reception of any data and/or information on the net,
6.7.5 all dysfunction of the network preventing the good progress of any game,
6.7.6 failure of any material of reception or communication circuit,
6.7.7 the loss of any data,
6.7.8 any damage caused by a virus, computing bog, technical failure,
6.7.9 any damage caused to the material of the player,
6.7.10 any failure preventing or limiting the possibility to participate to a game, or a failure that has damaged the player system. The player should take all the appropriate measures to protect the data and/or software stocked on the computer against all blow. The connection at the Site and the participation of the players at any game is done under the player responsibilities.
7. Contributions
7.1 By sharing any contribution (including any text, photographs, graphics, video or audio) with Carlos Poker contributors agree to grant to Carlos Poker, free of charge, permission to use the material in any way it wants (including translating and adapting it for operational and editorial reasons) in any of Maria Services Limited Games Network entities and partners.
7.2 Copyright in contribution will remain with the contributor and this permission is not exclusive, so contributor can continue to use the material in any way including allowing others to use it.
7.3 Contributor confirm that the contribution is her/his own original work, is not defamatory and does not infringe any EU laws, that s/he has the right to give Carlos Poker permission to use it for the purposes specified above, and that s/he has the consent of anyone who is identifiable in your contribution or the consent of their parent/guardian if they are under 16. We normally show contributor's name with the contribution, unless requested otherwise.
7.4 In order to participate in and contribute to select Carlos Poker community you may be required to register with Carlos Poker. Any personal information supplied to Carlos Poker as part of this registration process and/or any other interaction with Carlos Poker will be collected, stored and used in accordance with Carlos Poker Privacy Policy.
7.5 About your contribution: Contributions must be civil and tasteful.
7.5.1 No disruptive, offensive or abusive behaviour: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.
7.5.2 No unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.
7.5.3 No spamming or off-topic material: we don't allow the submission of the same or very similar contributions many times. Please don't re-submit your contribution to more than one discussion, or contribute off-topic material in subject-specific areas.
7.5.4 No advertising or promoting.
7.5.5 No inappropriate (e.g. vulgar, offensive etc) user names. Carlos Poker reserve the discretionary right to exclude from the community site in case contributor violates the rules here above.
8. Privacy Policy (including so-called Cookies)
8.1 Carlos Poker adheres to the Data Protection Act, other relevant regulations, legal notices and/or similar at the Place of the Contract taking account of the Data Protection Directive (EC Directive 95/46/EC) and the Electronic Communications Privacy Directive (EC Directive/2002/58/EC. Furthermore, Carlos Poker has adopted best practice when it comes to the principles of e-mail communication with Account Holders.
8.2 All the aforementioned is in place in order to assure Account Holders that at all times personal data is:
8.2.1 processed in accordance with the rights of the Account Holder concerned;
8.2.2 processed fairly and lawfully;
8.2.3 obtained only for a specific and lawful purpose;
8.2.4 adequate, relevant and not excessive to its purpose;
8.2.5 accurate and updated;
8.2.6 kept in a secure manner;
8.2.7 not kept longer than is necessary for its purpose;
8.2.8 not transferred to jurisdictions not adhering to the aforementioned Directives; and
8.2.9 is utilised for marketing purposes based on the so called opt-out principle.
8.3 Carlos Poker discloses personal data when ordered to do so by order of the Governing Authorities and/or under any legal provision contained in the Governing Law. For fraud detection and control purposes you agree that Carlos Poker has the right to transfer your personal data to third parties, including so-called AVS service providers and other partners. Furthermore, Carlos Poker reserves the right to disclose personal data to relevant recipients when Carlos Poker has reasonable grounds to suspect irregularities that involve a Carlos Poker Account.
8.4 Customer Relationship Management ("CRM") Carlos Poker reserves the right to process personal data for CRM purposes. However, only Account Holders that have agreed to the opt-out will receive marketing material.
8.5 The Account Holder has the right to require access to the Account Holder's own personal data and/or has the right to correct and/or erase wrong and/or inappropriate data. Queries regarding data privacy can be sent to info@carlospoker.com
8.6 Cookies, tags and other identifies ("cookies") The Carlos Poker website works by using cookies for the following purposes:
8.6.1 To identify the Account Holder's preferred language so it is automatically selected when the Account Holder returns to Carlos Poker
8.6.2 To ensure bets the Account Holder places are associated with the Account Holder's betting coupon and account
8.6.3 To ensure the Account Holder receives any bonuses the Account Holder is eligible for
8.6.4 For analysis of Carlos Poker website traffic to allow us to make suitable improvements Please be aware that it is not possible to use the Carlos Poker site without cookies. If additional information about Carlos Poker's use of cookies is requested, please email info@carlospoker.com
9. Responsible Gaming/Gambling
9.1 An Account Holder may set a limit on the amount the Account Holder may wager within a specified period of time.
9.2 If we believe that your gambling will cause you financial or personal difficulties then, we reserve the right to close your account.
9.3 Kindly be advised that remote gaming, including gambling, can be addictive.10. Casino
10.1 The Casino is arranged by Net Entertainment Malta Ltd. in Malta, a wholly owned subsidiary of Net Entertainment AB. Net Entertainment is a public company listed on the Nordic Growth Market, NGM Equity.
10.2 Carlos Poker is authorised by The Casino to represent, promote and market the services of The Casino.
10.3 Carlos Poker is authorised by to receive, hold and pay funds in relation to an Account Holder for the purpose of transactions and settlements with the Casino.
10.4 The Casino is a stand-alone service:
10.4.1 not managed and/or controlled by Carlos Poker;
10.4.2 not provided under The License held by Carlos Poker;
10.4.3 not included in the provisions of the License
10.5 Carlos Poker does not accept and acknowledge any liabilities whatsoever for transactions conducted to, from and/or with the Casino, except for funds being received, held and/or paid to and/or from a Carlos Poker Account in conjunction with arrangement with the Casino.
10.6 The Casino is restricted to individuals of legal age of majority only. You have to be at least eighteen (18) years of age to play. Any funds deposited by an individual who is not over eighteen (18) years of age shall be forfeited in favour of the Remote Gaming authority.
10.7 Participation in the games and the activity of the Casino (the "Games") is open only to residents of those jurisdictions where such participation is legal (the "Players"). By entering the Games, the Player acknowledges that he/she is resident in a jurisdiction where such activity is legal. Participation in the Games is void wherever prohibited by law.
10.8 The Player understands that the Games are for entertainment value only. The Player understands and acknowledges that no purchase is necessary or required to play the Games. If a Player wishes to play without betting money, he/she may do so. Where a Player wishes to play by betting money, he/she may not do so unless and until he/she has registered and has obtained a Carlos Poker Account.
10.9 Employees of the Company, its licensees, distributors, wholesalers, subsidiaries or other agencies, retailers and members of the immediate families of each are not eligible to participate in the Games.
10.10 Other conditions
10.10.1 The Player is not required to participate in the Games and such participation, if elected by the Player, is at the Player's sole option, discretion and risk. Materials of the Games (whether electronically obtained or obtained by other means) are automatically void if counterfeited, mutilated, forged, altered or tampered with in any way, if illegible, if mechanically or electronically reproduced, if obtained outside authorized legitimate channels or if they contain printing, production, typographical, mechanical, electronic or any other errors. Any and all materials submitted for prize claims become the property of the Company and will not be returned. The Company is not responsible for lost, late, illegible, incomplete, damaged, mutilated, misdirected, or postage due mail, requests, prize claims or entries. Liability for materials of the Games containing any error is limited to replacement. Taxes, if any, on any prize will be the Player's sole responsibility.
10.10.2 If a Player does not log onto his/her account on the Casino server via the Internet using the Player's "user name" and "password" for a period of 120 days, all balances may be removed from the Players’ account and paid to the same after a notification has been sent to the Player’s registered e-mail address. If the Player is deceased his/her immediate family will be located and paid the said balance.
10.10.3 By accepting any prize and/or winnings, the Player consents to the use of his/her name for advertising and promotional purposes without additional compensation, except where prohibited by law. The Player, by acceptance of a prize, acknowledges compliance with the Carlos Poker Rules and with all rules stipulated herein.
10.10.4 The Company makes no representations or warranties, implicit or explicit, as to the legal right of the Player to participate in the Games. Nor shall any of the Company's employees, licensees, distributors, wholesalers, affiliates, subsidiaries, advertising, promotion or other agencies, media partners, agents or retailers have the authority to make any such representations or warranties.
10.10.5 The Company shall not be required to maintain usernames and/or passwords. If the Player misplaces, forgets, loses, or is otherwise unable to enter the Casino because of anything other than Company error or, if a Player should give away, tell, share or lose his/her user name and/or password, the Company will not be responsible and cannot be held liable for any claims regarding that account.
10.10.6 The terms and conditions contained herein may be modified and/or amended only by the Company posting such modification and/or amendment in the "Terms and Conditions" section of the Web site.
10.10.7 The Company shall not be liable for computer malfunctions nor attempts by the Player to participate in the Games by methods, means or ways not intended by the Company. 10.11.2 The Player understands that the Casino takes no responsibility whatsoever, direct or indirect, for losses that may occur to the Player when using the Casino. In particular, Carlos Poker Casino will not be liable in the following scenarios:
10.11.2.1 In the event of Force Majeure;
10.11.2.2 In the event of the cancellation of Games for any reason;

10.11.2.4 An outbreak of hostilities, riot, civil disturbance, acts of terrorism;
10.11.2.5 Acts of government or of any authority having competence over Carlos Poker and/or the Company and/or the Player (including refusal or revocation of any license or consent);
10.11.2.6 Fire, explosion, flood, theft, malicious damage, strike, lockout or industrial action of any kind.
10.11.3 Whereupon a dispute should arise between the Casino and any of its Account Holder the Casino will, if so requested, make accessible to the interested members a detailed transaction record. Such information shall also be made available to legitimate third parties (e.g. a judge or a court) if the Player so agrees to or if Company is otherwise bound to do so according to Maltese law.
10.11.4 The Casino is operated from Malta by Net Entertainment Malta Ltd under their class IV license. Legal disputes between the Player and the Casino are to be solved in the Maltese courts, according to Maltese laws and regulations.
10.11.5 A Player cannot have more than one account.
