Below you find our General Terms and Conditions for Carlospoker, which will apply to all services transacted through www.carlospoker.com. Please read the terms and conditions carefully before accepting them. Note that the terms and conditions contain – and refer to – special rules for poker and Casino. You can close a gaming account with Carlospoker at any time.

1.1 Applicability
These General Terms and Conditions, including any special terms and conditions for poker and any others referred to in the General Terms and Conditions, apply between Mantaray SA and users of the services transacted through the carlospoker.com website.
1.2 CarlosPoker
CarlosPoker is a brand owned by Mantaray SA in Costa Rica. Mantaray I a full owned subsidiary of Parabol Ltd in UK with registration number 5083740, St James House, 13 Kensington square, London, W8 5HD London UK. CarlosPoker can be contacted via e-mail at info@carlospoker.com, by phone.
1.3 Transfer of rights
CarlosPoker reserves the right to transfer its rights and liabilities towards users to another company belonging to the same company group as CarlosPoker. If such a transfer of rights is required, CarlosPoker guarantees that the new company will fulfill all obligations to all users’ current at the time of transfer.
1.4 Changes
CarlosPoker reserves the right to make changes to the General Terms and Conditions from time to time. Current applicable terms and conditions are available at www.carlospoker.com .
1.5 Applicable law
Costa Rican law shall apply to these General Terms and Conditions.
1.6 Language
These General Terms and Conditions are available in several language versions. In the event of any discrepancies between the language versions, the English version shall take preference.
2.1 Application
To be able to play CarlosPoker Poker the user must have a valid gaming account. Application for an account is performed by the user filling in a registration form at www.carlospoker.com. The account may only be opened if the user accepts these General Terms and Conditions.
2.2 Gaming in certain countries and jurisdictions
If gaming via the Internet is illegal in a jurisdiction applicable to the user (normally the user's country of residence) the gaming account cannot be opened. The user is responsible for ensuring no local laws are infringed by gaming via www.carlospoker.com. Costa Rican citizens may not open a gaming account. CarlosPoker cannot be held liable for games played via the Internet if they are illegal.
2.3 Conditions for opening a gaming account
Gaming accounts can only be opened by users who:
- are 18 or over,
- register under their correct name,
- register under their correct home address,
- register under their correct e-mail address,
- register under their correct telephone number,
- register only one account (more than one account per user is not permitted).
- you are not classified as a compulsive gambler;
- You acknowledge that our random number generator will determine the outcome of the games played on CarlosPoker and you accept the outcomes of all such games. You further agree that in the unlikely event of a disagreement between the result that appears on the Software and the game server, the result that appears on the game server will prevail and you acknowledge and agree that our records will be the final authority in determining the terms and circumstances of your participation in the Carlospoker gaming activity.
2.4 User guarantees
Users who register guarantee that he/she
- fulfils the terms under item 2.2 (“Gaming in certain countries and jurisdictions”) and 2.3 (“Conditions for opening a gaming account”),
- do not act on behalf of some other person,
- do not pay money into a gaming account using a credit card or the like for which they are not entitled to use,
- do not pay money into a gaming account which has been derived from illegal activities,
- will advise any changes to relevant details without delay in accordance with item 2.3 (“Conditions for opening a gaming account”).
- are not colluding or attempting to collude or intending to participate, directly or indirectly, in any collusion scheme with any other player in the course of any game you play or will play on Carlospoker.
- the debit/credit card details supplied by you in the registration process are those of the registered account holder and the card has not been reported as lost or stolen;
- you are not one of our officer, director, employee, consultant or agent or of one of our affiliated or subsidiary companies, or suppliers or vendors, and you are not any of their relatives as well (for the purpose of this clause, the term “relative” means spouse, partner, parent, child or sibling). In any event that you have breached this prohibition, among others actions that will be taken against you, you will not be entitled to any of your winnings.
- you have not previously held a Player Account which was suspended or terminated either by us or by any other online gaming operator, charged back any monies via a Player Account or maintains a current Player Account; and
- in opening the Player Account you will not provide any information or make any statement to us which is untrue, false, incorrect or misleading.
2.5 Administration of access
CarlosPoker undertakes to ensure that access to gaming accounts is secure and confidential and in accordance with applicable legislation. Accounts in credit will not attract interest.
2.6 Payments and withdrawals from gaming accounts
Payments into gaming accounts can be made in the currency/ies stated on www.carlospoker.com. Only the payment amount stated at any time on www.carlospoker.com is permitted. Payments from a gaming account will be made to the different technology available from time to time on www.carlospoker.com. Payments directly to a bank is always possible.
2.7 Transaction fees
CarlosPoker has the right to debit transaction fees arising from users paying-in or withdrawals from a gaming account. Applicable fees are stated on www.carlospoker.com.
2.8 Handling of login information
Users are responsible for keeping their login details confidential, which entails that such details must not be shared with any third party. CarlosPoker may not be held liable for consequences arising from the user using login details which contravene these General Terms and Conditions.
2.9 Verification of identity/means of payment
CarlosPoker reserves the right to demand verification of the user's identity or means of payment (e.g. credit card) by requesting a copy of identity documents or other means.
2.10 Rejection, barring and closing of gaming accounts
CarlosPoker reserves the right to reject an application for a gaming account without stating a reason and to deny payment into an account. In the event of suspicion of infringement of these General Terms and Conditions, CarlosPoker also reserves the right to bar or close a gaming account without notice. The user can close his/her gaming account at any time.
2.11 Freezing or confiscation of credit
CarlosPoker reserves the right to freeze or confiscate funds in a gaming account in the event of a breach of these General Terms and Conditions and/or illegal activities arise in the course of play or use of the account.
3.1 Administration
CarlosPoker will retain personal details for administration of the user's gaming account (including transactions to and from the account), his/her participation in poker gaming and for general administration of financial transactions between the parties. Such details will be treated confidentially and not revealed to any third party to any extent than that necessary for the aforementioned administration unless the user has given consent for the same. The user is aware of and acknowledges that CarlosPoker's administrative procedures include the reporting of suspected breaches of these General Terms and Conditions or laws.
3.2 Telephone communication
All telephone communication between users and CarlosPoker's support and customer service are recorded for security and training purposes.
3.3 Cookies
www.carlospoker.com uses cookies to simplify use for the users and for administrative purposes.
4.1 CarlosPoker Poker
CarlosPoker Poker is an on-line service in which individuals can play poker against each other.
CarlosPoker is responsible for offering users access to their gaming account and thus to CarlosPoker Poker via www.carlospoker.com
4.2 Play at your own risk
Users take part in CarlosPoker Poker and Casino games at their own risk.
4.3 Poker client
To be able to take part in CarlosPoker Poker the user must download a client program, i.e. software. To be able to install the client, you must accept the license conditions applicable to the client and that will be presented to you prior to installation.
4.4 Rules

5.1 Information on www.carlospoker.com
Details found on www.carlospoker.com are for information purposes only. CarlosPoker provides no guarantees for the accuracy, correctness, actuality or reliability in general of such details.
5.2 Complaints
Complaints against CarlosPoker shall be made by the user within six months from the date of the event or circumstance that give rise to the complaint. CarlosPoker may not be held liable for claims made after the aforementioned six month period.
5.3 Limitation of liability
Carlospoker may not be held liable for injury or loss that may befall the user and that directly or indirectly is caused by
- mistakes, incorrect text, translation errors, spelling errors or the like
- system, software or communication errors via www.carlospoker.com
- system, software or communication errors via any third party
- breach of these General Terms and Conditions
- illegal actions
- advice given by CarlosPoker
- events outside CarlosPoker's control, including force majeure.
Should CarlosPoker be judged liable towards users by a court of law or other legal authority, CarlosPoker's liability shall be limited to the lowest amount of the payment ordered or net winnings or, if relevant, the credit balance registered on the user's gaming account.
6. Security
- We only allow access to playing games on Carlospoker through secured networks using encryption of the user name and password. You cannot play games on Carlospoker without passing our customer security login.
- We are using the best methods available today for the encryption of the Username and Password information, and any other sensitive information transferred to and from the client application and our servers, thus securing the Player and us against manipulation attempts by a third party. You will not break in, access or attempt to break in or access or otherwise by-pass our security. If we have a suspicion that you have attempted to or may be attempting to break in, access or otherwise by-pass our security or the Software, we will be entitled to terminate with immediate effect your access to Carlospoker and/or have your account blocked, and we reserve the right to inform the applicable authorities.
- We will only use your personal information in accordance with our Privacy Policy, which is set out in full at www.carlospoker.com/privacy.html. We reserve the right to amend the Privacy Policy at any time. However, we reserve the right to ask you to provide us with additional details and any such additional information will be kept confidential. We further reserve the right under certain circumstances to disclose certain details to relevant authorities should it be required to do so by law, an arm of the state or a regulatory body. Subject to the provisions of the privacy policy, this right to disclose personal information to bodies or authorities whose purpose is to investigate money laundering, fraud and other criminal activity will be to the extent required by law.
7. NOTICES
- You agree to receive communications from us in an electronic form. Electronic communications may be posted on the pages within the Website and/or the messages/help files of your client application, and/or delivered to your e-mail address. All communications in either electronic or paper format will be considered to be in "writing" and to have been received no later than five business days after posting or dissemination, whether or not you have received or retrieved the Communication. We reserve the right, but assume no obligation, to provide communications in paper format.
- In the interest of fair gaming, when the total amount of bonuses given per account exceeds 50%, the comp point ratio applied to the account may decrease.

8. TERM
This agreement is effective from the moment of acceptance by clicking on the “I agree” button, and shall remain in force indefinitely unless terminated in accordance with clause. For the avoidance of doubt it is agreed that you are bound by this Agreement if you use the Online Casino or the Website or the Software in any way, including, but not limited to, initiating or making a deposit through your Account or submitting your deposit details to us.
